| Governor Takes Next Step Towards Control of TCI |
|
In a telephone interview with the fp, H.E. Gordon Wetherell explained, "The purpose of the Order is to allow me to bring in different provisions at different times." Such provisions set out in the original Order in Council on March 18th included Suspension of the House of Assemby, Cabinet and Chief Exectutive powers among other items. However, in the interview, the Governor stated, "I do not intent to make use of the new Order before the hearing in the Court of Appeal." As to why he decided to bring the Order into affect when he does not intend to use it, H.E. Wetherell said the Order was passed by the Council and in so far as he would like to be flexiable to enact any of the powers at any time deemed necessary, he has taken on the Order immediately. The full statement can be read below: PRESS RELEASE I am today making a proclamation which brings into force The Turks and Caicos Islands Constitution (Interim Amendment) (Amendment) Order 2009. This enables me to bring into force different provisions of The Turks and Caicos Islands Constitution (Interim Amendment) Order 2009 made on 18 March 2009, which will suspend parts of the Constitution of the Turks and Caicos Islands, at different times. I do not presently intend to make use of this new Order before the hearing in the English Court of Appeal next month of the application for permission to appeal by the former Premier against the dismissal of his claim for judicial review; and my objective and that of the British Government remains full implementation of the March Order. However, the new Order provides a useful element of flexibility, for use if required in the sequencing of the March Order's implementation. Gordon Wetherell

In a statement to the press, H.E. Governor Gordon Wetherell has announced he is now bringing into force the amendment Order which allows him the flexibility to activate parts of the Order in Council to suspend the Turks and Caicos Islands Constitution. While the new Order is effective immediately, the Governor said in his statement to the press that he would not be utilizing these powers until such time the English Court of Appeal has had a chance to hear the case brought on by the former Premier Mr. Michael Misick later next month.
